The offence of Mischief can be found under 430(1) of the Criminal Code of Canada. That section reads:
“Every one commits mischief who wilfully:
a) destroys or damages property;

c) obstructs, interrupts or interferes with the lawful use, enjoyment or operation of property; or
d) obstructs, interrupts or interferes with any person in the lawful use, enjoyment or operation of property.”
Mischief is broken down into 2 separate offences – Mischief Under $5,000 and Mischief Over $5,000. Mischief Over $5,000 is more serious, and is considered a straight indictable offence. Punishments for Mischief
According to the Criminal Code of Canada, the maximum sentence for Mischief Over $5,000 is 10 years in jail. The maximum sentence for Mischief Under $5,000 is up to 2 years in jail and/or a $5,000 fine.
There is no minimum sentence for this offence. Accordingly, the lowest possible penalty, after being found guilty, is an Absolute Discharge, which does not trigger a criminal conviction.
